British Red Cross loses employment tribunal case because it failed to respond in time

An employee of the British Red Cross has won an employment tribunal claim after the charity did not respond in time.

Midlands East Employment Tribunal documents show that the claim brought by an employee named J Creasey succeeded because the charity “failed to provide a valid response on time”.

Employment judge Kimbra Welch decided that “a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the rules of procedure”.

The tribunal documents do not reveal any further details of the case.

A remedy hearing to decide any compensation that Creasey should receive has been scheduled for 5 October in place of the original hearing.

A British Red Cross spokesperson said: “As it is apparent that this matter is the subject of legal proceedings, it is not appropriate for us to comment any further at this time.”

It is the second tribunal outcome that has gone against the charity in the space of a week.

Another ruling, published last week, found another employee was unfairly dismissed and discriminated against on grounds of disability.
